01 Agreement to these terms
These terms form an agreement between you and Fijian Real Estate Ltd, a company registered in Fiji. By accessing the website, creating an account or submitting a listing you accept them in full.
If you are agreeing on behalf of a company or agency, you confirm you are authorised to bind that organisation.
02 What this website is
We operate an advertising platform that introduces buyers, tenants and sellers to one another and to our brokers. We are not a party to any sale, lease or tenancy that follows an introduction, and we do not act as your solicitor, valuer or financial adviser.
03 Accounts
- You must give accurate registration details and keep them current.
- You are responsible for everything done through your account and for keeping your password confidential.
- Tell us immediately if you believe your account has been used without your permission.
- We may suspend or close an account that breaches these terms.
04 Listing a property
When you submit a listing you confirm that you own the property or are authorised to advertise it, that the description, price and tenure are accurate, and that you hold the rights to every image you upload.
You grant us a non-exclusive licence to display, resize and promote your listing content on this website and our social channels for as long as the listing is live.
We may edit, decline or remove any listing — for example where the tenure cannot be verified, the images belong to someone else, or the property has already sold.
05 Acceptable use
You agree not to:
- Post anything false, misleading, discriminatory, obscene or unlawful.
- Advertise a property you have no right to advertise, or duplicate listings to gain prominence.
- Scrape, copy or republish listings, images or contact details in bulk.
- Send unsolicited marketing to users, or attempt to interfere with the security of the site.
06 Property information and title
Listings are supplied by owners, developers and agents. While we title-check the properties we broker directly, we cannot guarantee that every price, measurement, boundary or image on the site is accurate or current.
Freehold, State (Crown) lease and native (iTaukei / TLTB) lease each carry different rights and consent requirements. Always obtain independent legal advice and your own searches before committing to a purchase.
07 Fees
Browsing the website is free. Where a listing package, brokerage commission or marketing fee applies, it is agreed with you in writing before any charge is raised. All amounts are in Fijian dollars (FJD) unless stated otherwise and are exclusive of VAT.
08 Intellectual property
The Fijian Real Estate name, logo, page designs, text and photography we produce are our property or licensed to us. You may view and print pages for your own use, but you may not reproduce them commercially without our written consent.
09 Liability
The website is provided on an "as is" basis. To the fullest extent permitted by Fijian law we exclude liability for indirect or consequential loss, for lost profit or opportunity, and for any transaction you enter into with another user. Nothing in these terms limits liability for fraud or for anything that cannot lawfully be excluded.
10 Governing law
These terms are governed by the laws of the Republic of Fiji, and the courts of Fiji have exclusive jurisdiction over any dispute arising from them.
11 Changes to these terms
We may revise these terms from time to time. The revision date at the top of this page shows the current version, and continuing to use the website after a change means you accept the revised terms.
